Experience
Morgan provides advice on all aspects of resource consents, strategic planning and litigation in respect of zoning provisions, renewal and establishment of designations and compulsory acquisitions. He has acted for parties in Court-assisted mediations; declaration applications, consent appeals in the Environment Court, High Court and Court of Appeal; District Plan appeals; judicial review in the High Court; and enforcement actions.
Morgan’s recent experience includes:
- Representing parties opposed to wind farm projects in Central Otago (Project Hayes) and Wellington (Mill Creek);
- Provision of independent legal advice to the Boards of Inquiry on the proposed New Zealand Coastal Policy Statement and the Turitea wind farm application;
- Strategic planning advice to Wellington International Airport;
- Designation advice to a natural gas reticulator and retailer;
- Successful Environment Court appeals against a proposed Hilton hotel on Wellington’s waterfront;
- Procuring consents for large-scale residential subdivisions around Greater Wellington;
- Obtaining a plan change for a business industrial park at Silverstream;
- Co-authorship of an urban design case law review for the Ministry for the Environment;
- Obtaining consents for mixed use commercial/retail development in Lower Hutt.
